PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A10, seeking regular bail, in Crime No.52 of 2023 of Rampachodavaram Police Station, Alluri Sitharama Raju district. .'`- r` f=,B +.fy-~-->FA -
2. A case has been registered aga'lnSt the Petitioner herein and others for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short [the NDPS Act')_. 3.
Case of the prosecution, in brief, is that, on 17.05.2023, at about 06.30 PM, on receipt of credible information, the Sub- lnspector of Police, Rampachodavaram Police Station, Alluri Sitharama Raju district, along with his staff and mediators, while conducting raid at the outskirts of Chinna Geddada village of Rampachodavaram Mandal, found A2 to A5 in possession and illegal transportation of 350 KGs of Ganja on Hero Honda Shine Motorcycle bearing registration No.AP 07 AU 9513 and Hero Passion Pro motorcycle bearing registration No.AP 26 AT 1257. A2 to A5 confessed about purchase of Ganja from the petitioner herein and others. The contraband along with vehicles and other material was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 3 f®
5. A perusal of the material on record goes to show that basing on the confessional statement of co-accused, the name of the petitioner herein was shown as accused No.10 in the present crime. Except the said confessional statement, there is no other material to connect the petitioner herein to the alleged crime and no contraband was seized from his possession. Petitioner herein was arrested on 15.O7.2024 and since then he is languishing in jail. Statutory period of 180 days has been completed. Learned Assistant Public Prosecutor submitted that entire investigation is completed except filing of charge sheet. 6. ln view of the aforesaid facts and circumstances of the case, this 'Court is inclined to grant bail to the petitioner/A10 on the following conditions. i) The bletitioner/A10 shall be released on bail on his executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned I Additional Sessions Judge, Rajamahendravaram. il-) Qn release, the petitioner shall appear before the Station House Officer concerned, once in a week i.e., on every €-ritl±rLi4bJ=?
