The present application under Section 528 BNSS has been filed with a prayer to issue a direction to Chief Judicial Magistrate, Kushinagar to decide the application dated 17.01.2025 and to release the vehicle bearing Registration No. BR29BA4182 (Mahindra XUV 300) of the applicant, attached under Section 83 of Cr.P.C. in Criminal Case No. 4166 of 2024. After some arguments, learned counsel for the applicant does not want to press the application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order be returned to the learned counsel for the applicant after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
