This Criminal Revision Case is filed by the petitioner herein/accused No.1 against the order dated 04.12.2015 passed in Crl.M.P.No.1458 of 2015 in Crl.R.P-2025 in C.C.No.614 of 2013 by the learned Metropolitan Sessions Judge, Vijayawada, wherein the petition filed by the 2nd respondent herein seeking to condone the delay of 285 days in filing the revision petition was allowed.
2. It is brought to the notice of this Court by Sri S.S. Prasad, learned Senior Counsel appearing on behalf of the petitioner that the delay of 285

days in filing the revision petition was condoned by the learned Metropolitan Sessions Judge, Vijayawada on 04.12.2015. Subsequently, the main Crl.R.P.Nos.52 of 2014 and 107 of 2015 arising out of the order passed by the learned III Additional Chief Metropolitan Magistrate, Vijayawada in Crl.MP.No.1620 of 2014 in C.C.No.614 of 2013 were disposed of on 12.09.2016 by way of common order and dismissing both the revision petitions, which clearly indicates that the order of discharge passed by the learned Additional Chief Metropolitan Magistrate was confirmed. In view of the final disposal of Crl.R.P.Nos.52 of 2014 and 107 of 2015, the cause in the present criminal revision case does not survive for further adjudication and the matter would become infructuous.
3. Learned Assistant Public Prosecutor representing the Respondent- State has conceded with the submission made by the learned counsel appearing on behalf of the petitioner.
4. Recording the said submissions, this Criminal Revision Case is dismissed as infructuous.
Interim orders granted earlier, if any, shall stand vacated.
