Neutral Citation No. - 2025:AHC:122972 Court No. - 33 Case :- WRIT - C No. - 21823 of 2022 Petitioner :- Ibrar Ahmad Respondent :- State of U.P. and Another Counsel for Petitioner :- Ambleshwar Pandey,Dan Bahadur,Devaang Savla,Parmatma Prasad Pandey Counsel for Respondent :- C.S.C. Hon'ble Prakash Padia,J.
1. The order dated 14.06.2022 passed by the Respondent no. 3/Additional District Magistrate (City), Prayagraj is under challenged in the present petition by which the application dated 02.01.2021 submitted by the petitioner to delete the "Address 190 Kher Mahal West, District Dimapur State of Nagaland" and changed the same as "24B/25B, Indalpur, P.S. Naini, District Allahabad (Now Prayagraj)". 2. The aforesaid application was cancelled by the respondent no. 3 only on the ground that as per the Government Order issued by the Principle Secretary Home(Police) dated 02.05.2005,
"No Objection Certificate" is required by the erstwhile State (in the present case State of Nagaland) and since the same was not provided till date, no orders could be passed on the application submitted by the petitioner for change of his address. It is stated in paragraph no. 9 of the writ petition that the District Magistrate, Dimapur, Nagaland wrote a letter dated 12th July, 2021 to District Magistrate, Prayagraj by which "No Objection Certificate" has been issued by him, copy of which is appended as Annexure No. 4 to the writ petition. 3. It is further argued by the counsel for the petitioner that only
reason given by the respondent no. 3 while refusing the request of the petitioner for change of address is no more, hence a mandamus be issued directing the respondent no. 3 to take a decision in the matter. 4. Heard counsel for the parties and perused the record. 5. From perusal of record it transpires that the application submitted by the petitioner for change of his address was rejected by the respondent no. 3 vide order dated 14.06.2022 only on the ground that "No Objection Certificate" has not been provided by the concerned District Magistrate. As stated above the same has already been given by the District Magistrate, Dimapur, Nagaland on 12th July, 2021. 6. In this view of the matter, and also in the interest of justice, the Court is of the opinion that the order dated 14.06.2022 passed by respondent no. 3 is liable to be set aside and hereby set aside. 7.
The petitioner is directed to submit a fresh application ventilating all his grievances along-with all the necessary papers and documents especially the no objection certificate before the Respondent no. 3 or the authority who is competent in the matter with three weeks. If such application is filed within the stipulated period, the Respondent no. 3 or the authority who is competent in the matter will take a decision in the matter within a period of six weeks thereafter. 8. With the aforesaid observations, the writ petition is allowed.
