For Petitioner : Mr.K.Balu For Respondents : Mr.N.Muthuvel Government Advocate for RR16 to 18 ORDER The Civil Revision Petition has been filed to direct the learned Principal District Judge, Chengalpattu to dispose of the suit in O.S.No.579 of 2023, expeditiously. 2/9 https://www.mhc.tn.gov.in/judis 2.Heard Mr.K.Balu, learned counsel for the petitioner and Mr.N.Muthuvel, learned Government Advocate for the respondents 16 to 18. 3.The learned counsel for the petitioner would invite my attention the judgment of the Hon'ble Division Bench of this Court in W.A.Nos.3492 & 3493 of 2023, where the Hon'ble Division Bench of this Court directed the Civil Court to take up the civil proceedings on a day to day basis, without adjourning the same beyond five working days at any point of time and render its judgment and decree at the earliest. 4.The grievance of the revision petitioner is that despite specific directions issued by the Hon'ble Division Bench of this Court, the Civil Court has not been dispose of the suit till date. 5.Considering the limited relief sought for, notice to the respondents is dispensed with. 6.In the light of the above, the learned Principal District Judge, 3/9 https://www.mhc.tn.gov.in/judis Chengalpattu, is directed to dispose of O.S.No.579 of 2023, keeping in mind the directions of the Division Bench of this Court in W.A.Nos.3492 & 3493 of 2023 dated 15.12.2023, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. 7.With the above direction, the Civil Revision Petition is disposed of. The revision was allowed after hearing the learned counsel for the petitioner on 23.07.2025. Subsequently a mention has been made by Mr.K. Raja, learned counsel on behalf of the 1st respondent, plaintiff in the suit and hence, today the matter has been posted “for being mentioned”. 2. The learned counsel for the 1st respondent, plaintiff in the suit would state that only recently issues have been framed and on the date on which the Hon'ble Division Bench had directed disposal of the suit, within a period of three months, service of summons was also incomplete. He would further state that the 1st respondent plaintiff would have to mark more than 60 documents and it would not be possible to dispose of the suit, within a period of eight weeks and hence, he sought for a reasonable time to be granted to the trial court. The said request is strongly opposed by the learned counsel for the revision petitioner stating that the summons have been served, pleadings have been completed and issues have also been framed. He would also state the trial Court is conscious of the directions 7/9 https://www.mhc.tn.gov.in/judis issued by the Hon'ble Division Bench and therefore, there is no necessity to grant any further time. 3. I have carefully considered the submissions advanced by the learned counsel on either side. 4. If at all the trial Court is of the opinion that the suit cannot be disposed of expeditiously as directed by the Hon'ble Division Bench as reiterated in my order, dated 23.07.2025, it shall always be open to the learned Principal District Judge, Chengalpattu to seek for necessary extension of time or further time from the Hon'ble Division Bench, which disposed of W.A. Nos.3492 and 3493 of 2023, by order, dated 15.12.2023 directing the disposal of the suit to be decided expeditiously. It is also open to the 1st respondent plaintiff to move the Hon'ble Division Bench seeking extension of time, if so advised.
