(Oral) Though having carefully perused office order dated 24.04.2025 (Annexure P-7) vis-a-vis direction contained in judgment dated 20.01.2025 passed by this Court in CWP No.1331 of 2025, titled as Kamal Chand Vs. State of Himachal Pradesh and others, whereby direction was issued to the respondents to consider and decide the representation of the petitioner, this Court sees no illegality and infirmity in the impugned order, as detailed hereinabove, but having taken note of the fact that at the time of personal hearing, petitioner had made representation dated 11.04.2025 (Annexure P-6), thereby indicating one vacant station, where petitioner could be
posted, this Court, without going into the merits of the case, deems it fit to dispose of the same with a direction to respondent No.3 to consider and decide the representation dated 11.04.2025 (Annexure P-6) of the petitioner afresh expeditiously, preferably within ten days and in case station, as indicated in afore representation, is still vacant, respondent may consider petitioner for posting at that station taking note of the fact that in a meager salary of Rs.5500/-, it shall be very harsh and difficult for him to go daily to a station, which is at a distance of 55 Kms from his native place. Needless to say, authority concerned, while doing the needful, in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate orders.
