For the Respondents: Mr. L.N.Sharma, Additional Advocate General and Mr. Rajat Choudhry, Assistant Advocate General. ---------------------------------------------------------------------------- Jyotsna Rewal Dua, Judge This writ petition has been filed for grant of following substantive reliefs:- i) That the respondents may kindly be directed to verify the service book and LPC of the petitioner for the session 2022-23. ii) That the respondents may kindly be directed to send the Annual Confidential Report of the petitioner to the office of Director Elementary Education with a further direction to consider the case of the petitioner further promotion of the post of Post Graduate Teacher (PGT). iii) That the respondents may kindly be directed to release the salary of the petitioner w.e.f. May, 2022 to 16.12.2022 which comes to ₹6,00,000/- alongwith penal interest and with all consequential benefits such as, 3% 1 Whether reporters of print and electronic media may be allowed to see the order? Yes.
2 increment on the basis pay w.e.f. June, 2022 till date. iv) That the respondents No. 1 & 2 may kindly be
directed to take departmental action against the erring officials i.e. respondents No. 4 & 5 who are responsible for these all things and have harass the petitioner unnecessarily.”

Learned counsel for the petitioner submits that during pendency of the petition and pursuant to the orders passed in this matter, substantive grievances of the petitioner have now been redressed; The only surviving grievance of the petitioner is with regard to the interest to be paid by the respondents on account of delayed payment of her due and admissible salary; Petitioner is entitled to be paid interest on account of delayed payment of her salary in terms of relief No.(iii).
3. There is substance in petitioner’s submission. The salary of the petitioner w.e.f. May, 2022 to 16.12.2022 was admittedly not released by the respondents at the relevant time. Same was released only pursuant to the
order passed in this petition on 27.05.2025. Hence, interest is payable to the petitioner from the date the salary became due to her till the date it was released in her favour.
4. In view of above, the respondents are directed to pay 5% interest per annum for the delayed payment of salary to the petitioner within six weeks from today. The
3 interest shall be payable from due date of payment till the date of actual release. With the above observation, this writ petition stands disposed of. The petitioner is at liberty to seek appropriate remedy for redressal of her surviving grievance if any. Pending miscellaneous application(s), if any, shall also stand disposed of.
