Gudiya @ Guddi W/o Shri Laxman, Aged About 35 Years, R/o Rawat Mohlla, Shri Nagar, Police Station Shri Nagar, District Ajmer. (At Present Confined In Central Jail Ajmer.) ----Petitioner Versus State Of Rajasthan, Through Its Pp ----Respondent For Petitioner(s) : Mr. Vinay Pal Yadav For Respondent(s) : Ms. Arti Sharma, PP HON'BLE MRS.JUSTICE MANEESH SHARMA Order 22/05/2025 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of the accused-petitioner, who has been arrested in connection with FIR No.82/2024 registered at Police Station Shrinagar, District Ajmer for the offences punishable under Sections 341, 323 and 308 IPC. 2. Learned counsel for the accused-petitioner submits that the petitioner has falsely been implicated in the present case and from the record of the case, it is possible that in the right of private defence, such incident took place. He further submits that the accused-petitioner is a lady and charge-sheet has been filed and she is in custody since long and the trial of the case will take considerable time, therefore, further custody of the accused- petitioner would not serve any fruitful purpose, so, petitioner be released on bail. [2025:RJ-JP:21603] (2 of 2) [CRLMB-13995/2024] 3. Learned Public Prosecutor has opposed the submissions made by the learned counsel for the petitioner. 4. Heard learned counsel for both the parties and perused the material available on record. 5. Having considered the facts and circumstances of the case and considering the arguments so advanced by the learned counsel for both the parties; considering the serious nature of the crime and cause of death of deceased; further, it cannot be believed that the incident took place under the alleged right of private defence, so, looking to the gravity of the offence and nature of allegation levelled against the accused petitioners, I do not consider it a fit case for grant of bail to the accused- petitioners. 6. Accordingly, instant bail application is hereby dismissed. 7. The observations made hereinabove is only for the decision of the instant bail application and would not have any impact on the trial of the case in any manner. (MANEESH SHARMA),J SOURAV /7
