This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a Writ of Mandamus declaring the action of the respondent No.4 in not permitting the petitioner to discharge his duties as Sarpanch of Ramireddypalli Panchayath and further preventing the petitioner to enter into the gram panchyath as arbitrary, illegal, unjust, colourable

exercise of power, and in violation of Article 14, 19, 21 of the constitution of India and also the inaction of the respondents 2 and 3 in causing an inquiry on the complaint and representation dated 21- 10-2024 as illegal arbitrary and violation of Article 14, 19 21 and of the Constitution of India and against the principles of natural justice and consequently direct the Respondents to permit the petitioner to discharge his duties as Sarpanch of Ramireddypalli Gram Panchayath, Chandragiri Mandal, Tirupati District and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case.”
2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, Police are not preventing the Petitioner to enter into the village. 3.
For ready reference, the written instructions are extracted hereunder:
“The allegation leveled by the petitioner in Para No.4 of the Writ petition that the TDP supporters threatened the petitioner with the dire consequences that he would not be allowed into the village to discharge his lawful duties/responsibilities as Sarpanch and also the Police are hand-in- glove with the TDP supporters and they all are preventing him to enter into the village are not true and totally false and fictitious. As part of preventive measures, the local police advised the petitioner not to go to his village on 18.10.2024 to attend the funerals of his villagers as the situation in the village was not adjusted and there is a possibility that the villagers also contemplating taking vengeance against him for his booking criminal cases on the students, doctors and software techies of Kuchivari Palli village intentionally in connection with the incidents of setting fire to his assets when he approached the local police to inform his going into the village. Therefore, the allegations leveled in this writ petition are far away from the truth and devoid of merits.”
4. Sri P.Subhash, learned counsel for the Petitioner would submit, recording the same, the petition may be disposed of. 5. Considering the submissions made, the Writ Petition is disposed of. There shall be no order as to costs.
