PUBLIC PROSECUTOR The Court made the following: ORDER: The instant petition under Section 528 of BNSS has been filed, by the Petitioners herein, seeking a direction to the learned II Additional Judicial Magistrate of First Class, Bhimavaram to commence the trail in C.C.No.831 of 2016 forthwith and dispose of the case as expeditiously as possible. 2 2. Heard Ms.K.Varshitha, learned counsel representing Sri G.Yaswanth, learned counsel for the Petitioners and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor for the State. 3. Learned counsel appearing on behalf of the petitioners would submit that the C.C.No.831 of 2016 relating to the offences punishable under Section 498A IPC and Sections 3 and 4 of the Dowry Prohibition Act is pending before the trial Court for the last ten years without any progress. 4. As per the information received from the concerned Court, the delay in disposal of this case is due to missing of original charge sheet in this matter. Therefore, the learned trial Judge is directed to take steps for reconstruction of the charge sheet and proceed with the matter and dispose of the case as expeditiously as possible. The learned trial Judge is further directed to report the progress of the matter to the registry every month. 5. With the above directions, the Criminal Petition is disposed of. However, the presence of the petitioners 2 to 4 herein before the trial Court is dispensed with, unless there is a specific direction by the trial Court for their presence on particular dates.
