Challenge in this petition is the order of transfer dated 30.06.2025 whereby the petitioner has been transferred from Kondagaon to Mohla Manpur Ambagarh Chowki. 2. Learned counsel for the petitioner would submit that the petitioner is a district cadre employee. The petitioner was appointed on the post of Digitally signed by INDRAJEET SAHU Date: 2025.07.16 15:31:08 +0530 2 A.G.III vide order dated 16.11.2010 and posted at the office of Assistant Commissioner Tribal Development Jagdalpur. The State Govt. vide its notification dated 20.10.2022 amended Chhattisgarh Civil Services (General Condition of Service) Rules, 1961 and inserted the following rules as 5(e) which reads as under: “(ङ) अनुसूचित क्षेत्रों में निनयुक्त व्यनिक्तयों के संबंध में निशेष उपबंध.- इन निनयमों में अथा तत्समय प्रृत्त निकसी अन्य अचिधनिनयम, निनयम, आदेश, निनद)श में अंतर्विष्ट निकसी बात के होते हुये भी राज्य शासन द्वारा अचिधसूचित, अनुसूचित क्षेत्रों बस्तर संभाग / सरगुजा संभाग के अंतग5त आने ाले जिजलों तथा निबलासपुर संभाग के कोरबा एं गौरेला-पेण्ड्रा-मराही जिजला के व्यापक निकास के लिलए उक्त जिजलों / संभाग में लोक सेाओं में तृतीय / तुथ5 श्रेणी के जिजला स्तरीय एं संभाग स्तरीय पदों पर निनयुक्त व्यनिक्तयों का स्थानान्तरण / प्रचितनिनयुनिक्त/संनिलिलयन / संलग्नीकरण, जिजला स्तरीय पदों पर जिजले के एं संभाग स्तरीय पदों पर संभाग के बाहर नहीं निकया जायेगा ।" 3. Despite provision in the Transfer Policy dated 05.06.2025 (Clause- 3.14) that District Cadre Employee should be transferred within the District, yet the petitioner has been transferred from the office of Assistant Commissioner, Tribal Development, Kondagaon to the office of Assistant Commissioner, Tribunal Development, Mohla Manpur Ambagarh Chowki which is inter-district transfer. He would further submit that the petitioner has moved his representation to the transfer committee as provided under Clause-8 of the transfer policy dated 05.06.2025, yet his representation has not been considered till date. 4. Learned counsel for the State opposes the submission, however, he would submit that the writ petition may be disposed of with an observation that the committee shall decide the pending representation of the petitioner within stipulated time frame in accordance with law. 5. Considering the submissions made by the counsel for the parties and also considering the issue involved, the transfer committee is directed to decide the pending representation of the petitioner dated 01.07.2025 within a further period of two weeks from the date of receipt of copy of 3 this order in accordance with law on its own merit keeping in view the provisions of transfer policy and notification dated 20.10.2022. The petitioner is directed to produce a copy of this order within a week to the transfer committee. Till decision of the transfer committee, no co- ercive steps shall be taken against the petitioner pursuant to transfer order dated 30.06.2025 so far as petitioner is concerned. 6.
