By way of the present petition, the petitioner has prayed for the 2 following reliefs: “10.1 That this Hon’ble Court may kindly be pleased to allow the present writ petition preferred by the petitioner and call for the records pertaining to the present case. 10.2 That, this Hon’ble Court may kindly be pleased to issue an appropriate writ/order/direction to respondent authorities more particularly to respondent no. 2 to restore the excess unutilized land back to the petitioner. 10.3 That any other order/relief which this Hon’ble Court may deem fit, proper and just in the facts and circumstances of the present case may also kindly be awarded to the petitioner in the ends of justice along with the cost of the petition may kindly also be awarded to the petitioners.” 2. On perusal of the prayer in the present petition, it transpires that the petitioner has not made the National Highway Authority a party to the present petition and no relevant document has been filed with the petition which is defective one, therefore, I am not inclined to entertain the present petition with such a vague and sketchy prayer as there are no documents placed on record, to which learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with a liberty to file better constituted petition with all relevant documents. 3 3. Learned State counsel has no objection. 4. In view of the submission made by the learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty.
