For the State : Mr. Bandana Sinha, A.P.P. ------ 03/ 11.12.2025 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner is apprehending his arrest in connection with Kisko P.S. Case No. 19 of 2024, registered for the offence under Sections 310(4), 310(5) and 310(6) of Bharatiya Nyaya Sanhita, 2023 and Section 25(1-B)(a)/26/35 of the Arms Act, pending in the court of learned Judicial Magistrate, 1st Class, Lohardaga. 3. Learned counsel appearing for the petitioner submits that the name of the petitioner has come on the basis of confessional statement and nothing incriminating and even the arms have not been recovered from the possession of the petitioner. He next submits the petitioner was also an accused in another case, however, in the said case, he has already been acquitted by the learned court. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the name of the petitioner has come on the basis of confessional statement. 5. Considering that the name of the petitioner has come on the basis of confessional statement and nothing incriminating and even the arms have not been recovered from the possession of the petitioner and [ 2025:JHHC:37265] -2- further the petitioner in one other case, has already been acquitted by the learned court, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Lohardaga, in connection with Kisko P.S. Case No. 19 of 2024, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated:-11.12.2025 Amitesh/-
