THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO. 333 OF 2025 ORDER: This Criminal Petition, u/Sec.482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner, seeking anticipatory bail, in Crime No.132/2024 of Ponnalur Police Station, Prakasam District. 2. A case has been registered against the petitioner for the offence punishable u/Sec.85 of B.N.S.. 3. Case of the prosecution in brief, is that it is a case of harassment on a married lady by her husband and abetment to commit suicide that occurred prior to 08.11.2024 at about 10.00 am in Ponnaluru Village and Mandal in which the accused harassed her both mentally and physically by suspecting her character, blaming that she was having illegal contacts with the public, due to which she took rat poison and attempted to put an end to her life. Later she was brought to the Government Hospital, Kandukuru by her sister-in-law and her uncle on bike and got admitted her for treatment. After her admission, hospital intimation was sent to the Station House Officer, Kandukuru Town P.S. On its receipt, Head Constable went and recorded statement of victim, 2 on 06.11.2024 at 3.45 hours and she succumbed to injuries on 10.11.2024 at 7.16 pm while undergoing treatment. 4) Heard. Perused the record. 5) Learned Assistant Public Prosecutor submits that investigation is at nascent stage and some more witnesses are to be examined. 6) On a perusal of the material available on the record goes to show that the allegations made against the petitioner herein are that he harassed the deceased suspecting her fidelity and in view of the unable to bear the harassment meted out by the petitioner, the deceased has taken extreme step by consuming rat poison and committed suicide. In view of the gravity and nature of allegations and as investigation is at nascent stage, this Court is not inclined to consider the prayer of anticipatory bail to the petitioner at this stage. 7) Accordingly, the Criminal Petition is dismissed. _____________________________ JUSTICE K.
