Neutral Citation No. - 2025:AHC:135955 Court No. - 52 Case :- WRIT - A No. - 59350 of 2005 Petitioner :- Sukh Lal Respondent :- State of U.P. and Others Counsel for Petitioner :- Radha Mohan Pandey,A.K. Sharma Counsel for Respondent :- C.S.C.,B.D. Tripathi,P.D.Tripathi,Rohit Sahai Hon'ble Mrs. Manju Rani Chauhan,J. Case is called out. None appears for the petitioner. Learned Standing Counsel for the State is present. Record goes to show that the petition has been filed with the prayer to direct the respondents, specially respondent no.2 to make payment of pension to the petitioner since June, 2001 till date as well as the arrears along with interest and a further prayer to direct the respondent no.2 to decide the representation of the petitioner dated 5.7.2005. The case is listed in the category of oldest pending cases in the cause list, for priority hearing. A notice has been placed on the notice board specifically, mentioning that "old cases up to the year 2022 shall be taken up in the first round itself. In case of non-appearance, matter shall be dismissed as infructuous or otherwise, and in the cases, where the cause of action still survives, the concerned advocates are expected to mark them accordingly in the cause list. Failure to do so, may result in its dismissal as infructuous" but, neither the counsel for the petitioner has appeared nor has the case been marked to indicate that the cause of action still survives. This matter is pending since 2005. It appears that either the petitioner has lost interest in pursuing the matter or it has become infructuous. Accordingly, the petition is dismissed as infructuous.
