IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondent No.l to not to interfere in the civil dispute between pet and respondent no.4 and not to disturb the personal liberty of the Petitioner without following due process of law pending disposal of the Writ Petition in the interest of justice.

This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the Respondent No.l in disturbing the personal liberty of the Petitioner without following due process of law and insist the Petitioner to reside in Visakhapatnam Town, instead of residing at Srikakulam, contrary to the will and wish of the Petitioner as arbitrary and illegal and violation of Article 14, 19 and 21 of the Constitution of India and consequently direct the Respondent No.l to not to disturb the personal libeily of the Petitioner without following due process of law in the interest of justice...”
2. Heard Sri Y.Bhanu Sri Akhila, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. When the matter is taken up for hearing, learned Assistant Government Pleader for Home would submit that since the subject dispute is civil in nature, the police authorities are not interfering in the civil dispute. Both parties were counseled to avoid quarrel and were advised to approach the competent civil court for appropriate relief. No cognizable offence was detected and no FIR was registered. 4. Learned Counsel for the petitioner would submit that recording the same, the petition may be disposed of, giving liberty to the petitioner to pursue the matter before appropriate forum. 4
5. Considering the submissions of both sides, this Writ Petition is disposed of accordingly, granting liberty to the petitioner to work out his remedies before the competent Civil Court. There shall be no order as to costs.
