Heard the parties.
The petitioner has been made accused in connection with Mahuwatand P.S. Case No. 25 of 2025, for the offences registered under Sections 103(1)/3(5) of the B.N.S., 2023, pending in the court of Sri Raj Kumar Pandey, learned Judicial Magistrate, 1st Class, Bermo at Tenughat. Petitioner happens to be the father-in-law of the deceased namely Bharti Kumari, who died due to asphyxia because of hanging in her matrimonial home. Statement of several witnesses have been recorded in the case diary. These witnesses have stated that deceased used to frequently talk to one Nasir Ansari and her husband Hardeo Mahto used to chastise her. They have also stated that the deceased had committed suicide due to dispute with her husband. Ms. Navedita Kundu, learned counsel for the informant has vehemently opposed the prayer for bail and submitted that the child of the deceased has stated that the petitioner and her father had committed murder of the deceased. There does not appear to be any mark of violence on the person of the deceased. Several witnesses have stated that deceased has committed suicide because her husband used to oppose her nefarious relationship with another person. In view of the aforesaid facts, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Sri Raj Kumar Pandey, learned Judicial Magistrate, 1st Class, Bermo at Tenughat, in connection with Mahuwatand P.S. Case No. 25 of 2025.
