Kota Village, Nagalapuram Mandal, Tirupati District, without issuing a notice to the petitioner and without following due process of law, as illegal, arbitrary, unconstitutional, and unjust, in violation of Articles 14, 21, and 300-A of the Constitution of India, consequently set- aside the same and direct the respondents to continue the petitioner's dealership of Fair Price Shop No. 1019036, situated in T.P. Kota Village, Nagalapuram Mandal, Tirupati District and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents to continue the petitioner’s dealership of Fair Price Shop No. 1019036, T.P. Kota Village, Nagalapuram Mandal, Tirupati District, by suspending the proceedings in Roc. D/41/2024 dated 26.08.2025 issued by the 3RD respondent, pending disposal of the above writ petition, and pass Counsel for the Petitioner: 1. V VINOD K REDDY Counsel for the Respondent(S): 1. GP FOR CIVIL SUPPLIES 3 VS,J W.P.No.24661 of 2025 The Court made the following Order: The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:- “… to issue a writ or order or direction more particularly one in the nature of writ of mandamus declaring the proceedings in Roc.D/41/2024 dated 26.08.2025 issued by the 3rd respondent in cancelling the temporary dealership of the petitioner and appointing the 6th respondent as temporary dealer of Fair Price Shop No.1019036 situated in T.P. Kota Village, Nagalapuram Mandal, Tirupati District without issuing a notice to the petitioner and without following due process of law as illegal, arbitrary, unconstitutional and unjust in violation of Articles 14, 21 and 300-A of the Constitution of India, consequently set-aside the same and direct the respondents to continue the petitioner’s dealership of Fair Price Shop No.1019036, situated in T.P. Kota Village, Nagalapuram Mandal, Tirupati District, and to pass such other order or orders ….” 2. Today, when the matter came up for hearing, learned Assistant Government Pleader for Civil Supplies has furnished the copy of the proceedings of the 3rd respondent vide Roc.D/41/2024 dated 18.09.2025, withdrawing the impugned proceedings dated 26.08.2025, wherein, the petitioner’s authorization was cancelled, even without giving any prior notice, calling for explanation and on the other hand appointing the 6th respondent as a temporary dealer as stop-gap-arrangement until further orders. 3. In view of the fact that the said impugned proceedings have already been withdrawn by the 3rd respondent, recording the same, the writ petition is closed. However, the 3rd respondent is directed to supply essential commodities to the petitioner without any break, until and unless further 4 VS,J W.P.No.24661 of 2025 disciplinary proceedings are initiated as against the petitioner.
