[2025:RJ-JP:4395] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 622/2025 Mohit Malawat S/o Shri Rajkumar Malawat, Aged About 20 Years, R/o Plot No. A-42, Amar Nagar, Khirni Phatak, Police Station Vaishali Nagar, Jaipur. (At Present In Central Jail, Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Shailendra Singh Balwada For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 31/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.16/2025 registered at Police Station Vaishali Nagar District Jaipur (West) for the offence under Section 8/20 of NDPS Act.
Learned counsel for the petitioner submits that the accused petitioner has falsely been implicated in this case. Counsel further submits that contraband articles (Ganja) recovered from the petitioner weighing 4832 grams is less than commercial quantity. The accused-petitioner is in custody since 04.01.2025 and the trial of the case may take considerable time, therefore, the petitioner may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail application.
[2025:RJ-JP:4395] (2 of 2) [CRLMB-622/2025] Heard and perused the material available on the record. Considering the arguments advanced by the counsel for the parties and looking to the fact that quantity of recovered contraband articles from the petitioner’s possession is below commercial quantity and trial of the case will take considerable time and there is no criminal antecedents against the petitioner, therefore, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Mohit Malawat S/o Shri Rajkumar Malawat, in connection with FIR No. 16/2025 registered at Police Station Vaishali Nagar District Jaipur (West) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
