Petitioner has prayed for issuance of a writ in the nature of mandamus directing the Bank of Baroda to allow the petitioner to operate Locker No.3, which is bearing New No. 2566AX0144 and release the articles in favour of petitioner as nominee and legal heir. Admittedly the locker was maintained in the name of one Smt. Phool Kumari Sharma. The petitioner claims to be her son. Learned counsel for the respondent bank points out that in the application form for opening of locker, none is mentioned as a nominee. It is, therefore, submitted that only after a succession certificate is obtained from the competent forum that the bank can consider the petitioner's application. In view of the specific stand taken by the respondent bank that the petitioner is not the nominee, the proper course for the petitioner would be to approach the competent forum for issuance of succession certificate whereafter it will be open for him to approach the bank for necessary relief.
