For Respondent(s) : Mr. Vigyan Shah, AAG HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA HON'BLE MR. JUSTICE SANJEET PUROHIT Order 25/08/2025 The challenge in this appeal is to the order passed by the learned Single Judge dated 20.10.2023 whereby the application filed by the appellant seeking stay was rejected. It was noted by the learned Single Judge that the road has already been constructed ad-measuring 15 metre.
[2025:RJ-JP:33622-DB] (2 of 2) [SAW-925/2023] In view thereto, the claim of the petitioner that no construction should be done on the land on which he has patta issued by the Gram Panchayat, could not have been granted. The learned Single Judge has, thus rightly, passed the order which allowed the construction of the road. The petitioner would always have a right, if any, to claim compensation after having proved genuineness of the patta. With the aforesaid observations, the present Special Appeal (Writ) is dismissed. All pending application(s), if any, stand disposed of.
