2025:HHC:42522 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA
Execution Petition No.1247 of 2024 in CWP No.1872 of 2024 Decided on: 09.12.2025 Netter Singh & others
… Petitioners Versus The State of Himachal Pradesh & others … Respondents Coram Hon’ble Mr. Justice Ajay Mohan Goel, Judge. Whether approved for reporting?1 ____________________________________________________

For the petitioners : Mr. Vikas Rajput, Advocate. For the respondents : Mr. Rajat Chauhan, Assistant
Advocate General. Ajay Mohan Goel, Judge (Oral) Compliance affidavit stands filed. Learned Counsel for the petitioners submits that though the judgment that has been passed by this Court stands complied with by the State, however, the monetary reliefs have been restricted to three years before the filing of the petition, whereas the petitioners in CWPOA No.2782 of 2019, titled Narender Singh Thakur and others Versus State of H.P. and others have been given full benefits. 2. Having heard learned Counsel for the petitioners and having perused the judgment dated 27.03.2024, passed by the Hon’ble Coordinate Bench of this Court in CWP No.1872 of 2024, titled Amit Guleria & Ors. Vs. State of H.P. & Ors., in favour of the petitioners, this Court is of the considered view that there is no 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:42522 infirmity in the act of the State in restricting the monetary benefits to the petitioners for a period of three years preceding the date of filing of the petition. This Court is making this observation, for the reason that Narender Singh Thakur and others approached this Court by way of an Original Application and after the abolition of the Learned Tribunal also when the matter was transferred to the High Court of Himachal Pradesh, the said petition was registered as CWPOA No.2782 of 2019. This demonstrates that the Original Application was filed much before the year 2019 itself. On the other hand, the present petitioners filed the writ petition only in the year 2024 after the judgment in Narender Singh Thakur (supra) had attained finality. 3. In this light of the fact, the act of the State of restricting the monetary benefits to the petitioners three years preceding the filing of the petition cannot be faulted with. In fact, this Court is satisfied that the judgment in issue now stands complied with in letter and spirit. 4. The petition is accordingly disposed of.
Pending miscellaneous application(s), if any also stand disposed of accordingly. (Ajay Mohan Goel)
