Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioners have, inter alia,prayed for the following reliefs:- “A) That this Hon'ble Court may be pleased to issue the Writ in the nature of Certiorari or any other appropriate writ, order or direction may kindly be issued quashing and setting aside impugned. action of the Respondents, whereby the Private Respondents, who are admittedly junior to the petitioners and fall under Rule 11 (iii) of the Recruitment and Promotion Rules for the post of Assistant Engineer are being considered for promotion as against the category of employees which falls under Rule 11(ii) being patently illegal and arbitrary and unconstitutional besides the same being in violation to the settled principles of service jurisprudence; B) That this Hon'ble Court may be pleased to issue the Writ in the nature of Certiorari or any other appropriate writ, order or direction may kindly be issued quashing and setting aside impugned order Dated 05.02.2025 (Annexure P-6), whereby the ACR's of the private respondent has been forwarded for consideration for promotion to the post of Assistant Engineer (Civil); C) That this Hon'ble Court may be pleased to issue the Writ in the nature of Mandamus or any other appropriate writ, order or direction may kindly be issued directing the Respondents to consider the petitioners for promotion to the post of Assistant Engineer (Civil) over and above the Private Respondents under Rule 11 (iii) of Himachal Pradesh, Department of Irrigation and Public Health, Assistant Engineer (Civil), Class-I (Gazetted), Recruitment and Promotion Rules,2022; D) That the cost of the petition may kindly be awarded in favour of the Petitioners and against the Respondents.” 2. When this case was taken up on 06.07.2026, the following order was passed:- “Learned counsel for the respondent has handed over office order dated 19.09.2025 issued by the Competent Authority and on the strength thereof, he submits that the grouse of the petitioners stand redressed by way of office order. Learned counsel for the petitioners submits that he may be granted some time to go through the same. As prayed for, list on 09.07.2026.” 3. On the backdrop of the subsequent development as taken place, obviously this petition has lost its efficacy, accordingly, the same is disposed of, so also the pending miscellaneous application(s), if any.
