GP FOR SERVICES II The Court made the following: 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.25458 of 2025 O R DE R: The present Writ Petition is filed to declare the action of the Respondents in not concluding the Departmental Proceedings initiated against the Petitioner on 20.11.2016 vide G.O.Rt.No.793 Agriculture and Cooperative (VIG-II) Department, though 9 years have lapsed, while withholding the pensionary benefits, including full pension, retirement gratuity, and encashment leave, as illegal and arbitrary. 2. The facts leading to the filing of the Writ Petition are as follows: The Petitioner, while working as Secretary Grade-II, had retired from service on 31.07.2020. While so, a Charge Memorandum dated 20.11.2016 vide G.O.R.T.No.793 was issued on the Petitioner making certain allegations. Thereafter, the Petitioner submitted her explanation to the said charges. Even after six years had passed, the Respondent Authorities had not finished the disciplinary proceedings. Hence, the present Writ Petition. 3 3. Learned Assistant Government Pleader submits that the Respondent Authorities would finish the Disciplinary Enquiry in accordance with the directives provided by the Andhra Pradesh Government in G.O.Ms.No.91 General Administration (SER.C) Department dated 12.09.2022. 4. Having heard the respective counsel, it would be appropriate to direct the Disciplinary Authority to ensure that the enquiry shall be concluded within a period of six months from the date of receipt of a copy of this order as specified in G.O.Ms.No.91 General Administration (SER.C) Department dated 12.09.2022. There shall be no order as to costs. 5. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
