The communication dated:04.11.2019 issued by the first respondent vide Annexure-D is called into question in this Writ Petition on several grounds as setout in the Memorandum of Writ Petition. 3. Counsel for the respective parties urged several contentions. Heard the arguments and perused the Writ papers with care. - 3 - NC: 2025:KHC:7158 WP No. 52536 of 2019 4. Counsel Sri.S.Vivekananda., in presenting his arguments strenuously urged that the Inspector of Legal Metrology and formed an opinion that the dresses sold by the petitioner company is a pre packaged commodity and as such the Rules 6 (1) (d) and 18(1) of the Legal Metrology (Packaged Commodities) Rules, 2011 are applicable. He argued by saying that the communication is nothing but an order. Counsel therefore submits that an appropriate order may be passed. AGA submits that an appropriate order may be passed. 5. The communication dated:04.11.2019 is furnished along with the Writ Petition and the same is marked as Annexure-D. A perusal of the same would reflect that the Inspector of Legal Metrology has called upon the petitioner to appear before him and urge its contentions. Hence, it is only a communication and it is not an order as contended by the petitioner. I find no justification to quash Annexure-D. The petitioner is at a liberty to urge all the contentions before the Inspector of Legal Metrology. Since the petitioner is represented by its counsel, the authorized person of the petitioner is directed to appear before the Inspector of Legal - 4 - NC: 2025:KHC:7158 WP No. 52536 of 2019 Metrology on 18.03.2025 and urge all its contentions before the Inspector of Legal Metrology. The Inspector of Legal Metrology shall consider the contentions of the petitioner and passed order in accordance with the law. 6. Resultantly, the Writ Petition is disposed of.
