The applicant has filed the present application seeking condonation of the delay in filing the revision petition. It is asserted that the matter was decided on
28.12.2024. The applicant was not present in the Court. He could not contact his counsel as his phone was lost. His counsel could not inform him about the decision in the case. There were court vacations in January and February. The applicant met with an accident at Theog Bye-pass and received minor injuries. He was informed in April about the decision. He tried to settle the matter with the accused. He collected half of the amount and approached the complainant, who demanded the possession of the shop. The accused handed over the vacant possession to the complainant on 09.6.2025. Learned Counsel informed the accused that he had to file a revision, and the settlement with the complaint was not sufficient to escape from the punishment. Hence, the application.

The plea of the applicant is duly supported by an affidavit, and there is no reason to disbelieve it at this stage. The fact that there were winter vacations in the Court can be verified from the notification issued by the Registrar of this Court notifying the winter vacations w.e.f. 13.01.2025 till

22.02.2025. The applicant has also filed a receipt regarding the handing over of the possession to the complainant. Therefore, the plea taken by the applicant explaining the delay has to be accepted as correct.

Consequently, the present application is allowed, and the delay in filing the revision petition is ordered to be condoned.

Application stands disposed of.
