"To quash the FIR in Cr. No.120/2024 of Huliyar Police Station registered for the offences punishable u/s 3, 4 and 5 of the Medical Termination Of Pregnancy Act, 1971 and u/s 312, 511 of IPC which is pending on the file of Addl. Civil Judge (jr. Dn) and JMFC at Chikkanayakanahalli and pass any other reliefs."

3. A perusal of the material on record will indicate that Petitioner No.2 is the owner of Kalpatharu Hospital while Petitioner No.1 is the husband of Petitioner No.2. On 26.06.2024, a raid was conducted by the Respondent No.2 at the said Hospital, pursuant to which, the Respondent No.2 filed the instant complaint alleging that the Petitioners are guilty for the offences punishable under Sections 3, 4 and 5 of the Medical Termination of Pregnancy Act, 1971 r/w Sections 312 and 511 of IPC. In this context, it would be necessary to reproduce the complaint averments which are as under: ಾನgÉ, ಷಯ:- ಹು ಾರು

4. A perusal of the aforesaid complaint and the material on record will indicate that it is an undisputed fact

HC-KAR NC: 2025:KHC:21489 CRL.P No. 9570 of 2024 that both the Petitioners are not doctors and Petitioner No.1 is merely the husband of Petitioner No.2, who is the owner of the Kalpatharu Hospital where the raid conducted by the Respondents. It is relevant to state that except noticing that operation was being conducted in the operation Theater of the Hospital, there is no allegation made by either any of the victims or anyone else that the operation that was being conducted at the time of raid involved medical termination of pregnancy thereby attracting the alleged offences. In addition thereto, it is also pertinent to note that except the aforesaid allegations made in the complaint, there is no other legal or acceptable material to establish that the Petitioners who are undisputedly not doctors are guilty of the alleged offences.
This fact has been noticed by this Court in the interim order dated 23.10.2024 which is as under:
"Heard the learned counsel for petitioners and the learned Additional State Public Prosecutor for the State. The learned Additional State Public Prosecutor has

The records would prima facie indicate a shoddy investigation by the Investigating Officer, which cements the submissions of the learned counsel for petitioners that there is no evidence qua the ingredients of the offences under the Medical Termination of Pregnancy Act, 1971. Learned Additional State Public Prosecutor would now submit that further investigation has to be conducted by different investigating officers as the offences projected are grave in nature. He submits that he would steer clear the controversy with regard to the fresh investigation to be conducted, on the next date of hearing. Interim protection granted earlier, is extended till the next date of hearing. The petitioners are directed to co-operate with the investigation."

Under these circumstances, in the light of the fact that the Petitioners are not doctors, coupled with absence of any allegation or material to establish commission of the offences by the petitioners, it cannot be said that the Petitioners are guilty of the alleged offences and consequently continuation of the impugned proceedings qua the Petitioners would amount to abuse of

ORDER
i) Petition is hereby allowed.
ii) The impugned proceedings in Cr. No.120/2024 of Huliyar Police Station registered for the offences punishable u/s 3, 4 and 5 of the Medical Termination Of Pregnancy Act, 1971 and u/s 312, 511 of IPC which is pending on the file of Addl.
