05/ 11.12.2025 Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner is apprehending his arrest in connection with Chanho P.S. Case No. 145 of 2025, registered for the offence under Sections 317(5), 338, 336(3), 340(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, Section 33 of the Indian Forest Act and Section 30(ii) of the Coal Mines Act, pending in the court of learned Judicial Magistrate, Ranchi.

Learned counsel appearing for the petitioner submits that a truck was intercepted along with the loaded coal and the owner has taken the name of the petitioner. He also submits that the petitioner is nothing to do with the said seized coal. He next submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-14 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the owner of the truck has taken the name of the petitioner.

Considering that the petitioner is neither the owner nor the consignee of the coal and further the petitioner is having no criminal

antecedent and disclosure to that effect has been made in para-14 of the petition, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand), with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ranchi, in connection with Chanho P.S. Case No. 145 of 2025, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
