This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a Writ of Mandamus declaring the inaction of the Police in properly investigating the crime in FIR.No.143 of 2024 dt. 25.08.2024 registered for the alleged offences U/s.329(4). 118(1), 115(2), 49 r/w 3(5) BNS without including the Sections 74 and 109 of BNS against the unofficial Respondents, as illegal, arbitrary, against in violation of principles of natural justice and against ail settled principles of law and consequently direct the Respondents Police to investigate properly by adding the provision of law i.e.. Section 74 and 109 of BNS apart from the Sections U/s.329(4), 118(1), 115(2), 49 r/w 3(5) BNS and to take proper action as per against the unofficial Respondents and filed charge sheet against the unofficial Respondents.”

Ms.K.Tulasi Durgamba, learned counsel for the Petitioner would submit that the Police are not properly investigating Crime No.143 of 2024 on the file of Puttur Police Station, Tirupathi District and have not concluded the investigation and a direction may be given to the Police to properly investigate the matter and file charge sheet. 3. Sri V.Farooq, learned Assistant Government Pleader for Home would submit that the Court may pass appropriate orders. 3

Considering the submissions made, the Writ Petition is disposed of directing the Police to take the grievance of the Petitioner into consideration and conclude the investigation in Crime No.143 of 2024 on the file of Puttur Police Station, Tirupathi District and file a report in accordance with law, within a period of three months from the date of receipt of copy of this order. There shall be no order as to costs.
