Neutral Citation No. - 2025:AHC:60526-DB Court No. - 29 Case :- WRIT - A No. - 3872 of 2025 Petitioner :- Vishal Mishra Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Amit Shukla Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Praveen Kumar Giri,J.
1. It appears that the vehicle in question was financed to fourth respondent by respondent no. 3. The fourth respondent has allegedly defaulted in repayment of loan, as a result of which, the vehicle has been repossessed.
2. Petitioner claims to have purchased such vehicle in the auction. An application has been moved for mutating the petitioner's name, which is engaging attention of the Regional Transport Officer i.e. respondent no. 2. It is submitted that merely on account of an application moved by respondent no. 4, the application of petitioner for mutating the vehicle in his name is not being accorded consideration. It is also pointed out that the vehicle itself was surrendered due to default in repayment of loan and no legal proceedings are pending before any forum in that regard.
3. Considering the nature of order proposed to be passed, we do not deem it necessary to issue notices to respondent nos. 3 & 4. Respondent Nos. 1 & 2 are represented by the Chief Standing Counsel.
4. In the facts of the present case, we find that the issue relating to mutation of petitioner's name over the vehicle in question is engaging attention of the second respondent, therefore, it would be appropriate to dispose of this petition with a direction upon the second respondent to pass appropriate orders on the pending application of the petitioner, after hearing fourth respondent, within a period of six weeks, from the date of presentation of a certified copy of this order.
5. With the above observations and directions, this writ petition stands disposed of. Order Date :- 22.4.2025 Ranjeet Sahu Digitally signed by :- RANJEET SAHU High Court of Judicature at Allahabad
