This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.106/2025 registered at Police Station Pasan District Korba (C.G.) for the offence punishable under Section 105 of B.N.S. Act. 2. Case of the prosecution, in brief, is that on 21.03.25 at about 8.30 pm GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.07.09 18:39:21 +0530 2 the applicant has given information before Police Station Bango about the death of his wife namely Vandana Sahu who died on 21.03.25 at about 6.00 pm due to flow of current in the wire in the field, thereafter police has registered Merg No.0/25 and matter has been sent for further investigation before Police Station Pasan. That after investigation police has registered FIR on 09.06.25 against the applicant U/S 105 of B.N.S. Act. 3. Learned counsel for the applicant submits that the applicant happens to be the husband of the deceased. It is stated that in the courtyard there was fencing of electric wire and she had gone to save the animal but she was electrocuted. He would submit that the applicant is in jail since 9/06/2025, charge sheet has been filed and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application. She has pointed out that the father of the deceased had given statement before the Investigating Officer under section 180 BNS stating that the applicant had some extra marital affair with another women on account of which he committed the said act. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, also considering the fact that the applicant who is the husband of the deceased had not taken any precaution and deceased was electrocuted as she came in contact with the fencing of electric wire and also considering the 3 fact that father of the deceased had given statement before the Investigating Officer under section 180 BNS stating that the applicant had some extra marital affair with another women on account of which he committed the said act, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant Virendra Sahu involved in Crime No.106/2025 registered at Police Station Pasan District Korba (C.G.) for the offence punishable under Section 105 of B.N.S.
