The present contempt application has been filed pleading willful disobedience of the order dated 21.2.2024 passed by this Court in Matters Under Article 227 No. 1880 of 2024. Through order dated 21.2.2024, this Court passed the following restrain order :- "Till the next date of listing, the defendant-respondents are restrained from demolishing the three shops owned by the petitioner subject matter of O.S. No. 275 of 2021, Tej Singh v. Nagar Panchayat and others, pending in the Court of Civil Judge (Junior Division), Kaimganj, District Farrukhbad or dispossessing the petitioner therefrom otherwise than in due course of law." It is stated in the contempt application that the opposite party has demolished the shops, i.e., the suit property, in disobedience of the order passed by this Court. A reading of the order dated 21.2.2024 shows that this Court had restrained the opposite party from demolishing the shops and dispossessing the petitioner therefrom otherwise than in due course of law. There is no plea in the affidavit filed in support of the contempt application that no notice was issued or served on the applicant and further the applicant was not given any opportunity of hearing before the shops were demolished. In view of the aforesaid, the necessary facts to show disobedience of the order has not been stated in the affidavit filed in support of the contempt application.
