Neutral Citation No. - 2025:AHC:72087 Court No. - 6 Case :- WRIT - A No. - 3658 of 2025 Petitioner :- Tarkeshwar Tiwari Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Anil Kumar Pandey Counsel for Respondent :- C.S.C.,Pranesh Dutt Tripathi Hon'ble Saurabh Shyam Shamshery,J. 1. Heard Sri Anil Kumar Pandey, learned counsel for petitioner and Sri Pranesh Dutt Tripathi, Advocate for Respondents-2 to 4. 2. Petitioner has approached this Court with grievance that he has not been paid salary from 30.12.2015 to 30.04.2016. 3. Learned counsel for petitioner in support of above prayer refers the averments and documents annexed alongwith this writ petition. 4. Learned counsel appearing for Respondents-2 to 4 has received written instructions that salary for aforesaid period has been determined and on 26.03.2025 an administrative order has been passed and it has been forwarded to Finance and Accounts Officer at the office of District Basic Education Officer, Kushi Nagar and he assures that payment shall be made within a short period, if there is no legal impediment. 5. Learned counsel for petitioner fairly submits that at this stage there is no reason to doubt on above submission made by learned counsel for respondents on basis of written instructions. However, he prays that payment for aforesaid period be made within a short period since above referred order is dated 26.03.2025. 6. I have considered the above submissions and since statement of counsel for respondents is based on written instructions, therefore, there is no reason to doubt on it. However, Finance and Accounts Officer at the office of District Basic Education Officer, Kushi Nagar shall ensure that payment, if already not made, be made within a short period. 7. At this stage Court takes note that above order dated 26.03.2025 is communicated to petitioner, however, his conduct is not fair since he has not disclosed about said letter to his counsel. Still ignoring the said carelessness, this writ petition is disposed of that since grievance of petitioner is adequately addressed, therefore, payment for aforesaid period shall be made within a short period.
