Neutral Citation No. - 2025:AHC:82197-DB Court No. - 29 Case :- SPECIAL APPEAL No. - 197 of 2025 Appellant :- Pankaj Kumar Swarnkar And Another Respondent :- State Of U.P. And 10 Others Counsel for Appellant :- Samarath Singh,Santosh Kr. Singh Paliwal,Sr. Advocate Counsel for Respondent :- Apurva Hajela,C.S.C.,M.N. Singh Hon'ble Ashwani Kumar Mishra,J. Hon'ble Praveen Kumar Giri,J. The appellants before this Court have been impleaded as respondent nos. 9 and 10 in the pending writ petition No. 14881 of 2024, wherein, an interim order has been passed by learned Single. Various submissions are urged by Sri G.K. Singh, learned Senior Counsel, in support of the present appeal questioning the grant of interim relief to the writ petitioners as a result of which the claim of the appellants for promotion is stated to be withheld. Sri R.K. Ojha, learned counsel for the writ petitioners objects to the locus of the appellants to question the grant of interim relief and submits that the writ petition itself ought to be heard finally since the rights of the writ petitioners are yet to be determined. In the facts of the present case, we are not inclined to embark upon an enquiry with regard to the cause brought before the learned Single Judge, on merits, as the issues are yet to be determined in pending writ. Since the claim of the appellants for promotion is apparently withheld for such reason we permit the appellants to approach the learned Single Judge with a prayer for fixing an early date for consideration of the writ petition on merits. In peculiar facts of the case, we deem it appropriate to request the learned Single Judge to take up the petition as per His Lordships earliest convenience. The special appeal is consequently consigned to records. Order Date :- 17.5.2025 K.K. Maurya Digitally signed by :- KAMLESH KUMAR MAURYA High Court of Judicature at Allahabad
