The present contempt application has been filed pleading wilful disobedience of the order dated 01.05.2023 passed by this Court in Writ - C No. 13565 of 2023 whereby, this Court had directed the opposite party to decide the objection/representation dated 02.02.2023 allegedly filed by the petitioner against the provisional assessment. It is the claim of the applicant/petitioner that his objection/representation has not yet been decided. In case, the final assessment is made under Section 126(3) of the Electricity Act, 2003, the applicant shall have the remedy to challenge the same under Section 127 of the Electricity Act, 2003 or in other legal proceedings available to him. In case, the objections have not yet been decided and final assessment has not yet been made, no occasion arises for this Court to take cognizance under the Contempt of Courts Act, 1971 as no bill is issued on the basis of provisional assessment. The bill is to be issued only after final assessment, which as has been stated earlier, can be challenged either under Section 127 of the Electricity Act, 2003 or other legal remedies available to him. In view of the aforesaid, no further orders are required to be passed in the present contempt application. The contempt application is disposed of. The file of the case be consigned to records.
