THIS CIVIL CONTEMPT PETITION IS COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE K.SOMASHEKAR and HON'BLE MR JUSTICE VENKATESH NAIK T - 3 - NC: 2025:KHC:1558-DB CCC No. 1036 of 2022 ORAL ORDER (PER: HON'BLE MR JUSTICE K.SOMASHEKAR) This contempt proceedings is initiated by the complainant against the accused for disobedience of the order dated 24.06.2021 passed by learned Single Judge in W.P.No.25577/2017, whereunder the writ petition was allowed and the impugned endorsement dated 16.11.2016 was quashed and the matter was remitted back to the Government to re-consider the case of the petitioner for appointment on compassionate grounds bearing in mind the observations made in the course of that order, if the petitioner is found otherwise eligible. It is further stated therein that while considering the case of the petitioner, the State shall consider dependency and the law with regard to grant of compassionate grounds as on date and in the event, the petitioner is offered appointment on such consideration, she shall furnish an affidavit of undertaking that she would take care the mother of the deceased Government servant. 2. Learned counsel, Sri. Adinarayan, appearing for M/s. A.N.N. Associates is neither present before the Court physically nor through video conference. 3. Learned Addl. Government Advocate Smt. Namitha Mahesh, appearing for respondent No.6 is present before the Court physically and facilitated pendency of the proceedings in W.A.No.676/2023 - 4 - NC: 2025:KHC:1558-DB CCC No. 1036 of 2022 relating to the order passed in W.P.No.25577/2017 dated 24.06.2021, whereunder in the said writ appeal, the appellants had made out a case for interim order and ad interim stay of the order dated 24.06.2021 passed by the learned Single Judge in W.P.No.25577/2017 was granted. In the mean-while, learned Addl. Government Advocate also submitted the compliance affidavit dated 21.02.2023 filed by accused No.3 and the endorsement dated 14.12.2022 vide Annexure-R1 issued to the complainant in compliance of the order passed by learned Single Judge. Therefore, keeping in view the submissions made by learned Addl. Government Advocate and the compliance affidavit, this contempt proceedings are hereby dropped.
