By the present writ petition, the petitioner is seeking compensation towards the death of the petitioner’s 10 years old son, who died because of stray dog bite. The petitioner is aggrieved by the in action on the part of the respondent, who are not considering the pending representation dated 23.09.2017 (Annexure P/6), which is pending before the Collector Korba District Korba. 2. Learned counsel for the petitioner by referring several judgments of this Court (Annexure P/8) submitted that, the petitioner is entitled compensation from the State Government, as the petitioner’s son died due to dog bite and he submits that the respondent/State has to consider the representation submitted by the petitioner for grant of compensation in line of judgment delivered by this Court in several judgments i.e. WPPIL No. 24/2017 and WPC No. 1856/2018. Learned counsel for the petitioner further submits that the petitioner has not received any compensation from any institution till date towards his son’s death. 3. On 20.01.2025, there is a direction to the State counsel to seek instruction about the status of the pending representation dated 23.09.2017 before the Collector Korba. 3 4. Learned counsel for the State would submit that the representation of the petitioner is still pending and it has not been decided till date, however she submits that as the representation is pending before the Collector, the Collector shall decide the representation dated 23.09.2017 in the light of the observation made by this Court in WPC No. 1856/2018 dated 10.10.2018 and WPC No. 4652/2019. 5. I have heard learned counsels for the parties and perused the pleadings of the petitioner. 6. The petitioner’s 10 years old son died due to dog bite on 24.02.2017 and the petitioner has approached the District Collector on 23.09.2017 seeking compensation towards the death of her son, but the said representation has not been considered till date, hence the Collector Korba is directed to consider the representation dated 23.09.2017 (Annexure P/6) in accordance with law and the guidelines and law laid down by this Court in WPC No. 1856/2018 and WPC No. 4652/2019, the Collector shall decide the said representation within a period of 45 days from the receipt of copy of the order.
