HON'BLE MR. JUSTICE SUDESH BANSAL Order 01/05/2025
1. Instant writ petition has been preferred by petitioner, feeling aggrieved by not offering appointment on the post of Asha Sahyogini at Dausa II Lawan Village against the vacancies advertised on 15.11.2021.
2. Indisputably, on the post in question, respondent No.7– Ms. Anita has been given appointment.
[2025:RJ-JP:18438] (2 of 2) [CW-17378/2022]
3. It is an admitted case of petitioner that she scored four marks, whereas respondent No.7 scored 5 marks. Petitioner raised an issue that she was not awarded one mark in the category of NFSA, but from perusal of application form submitted by petitioner (Ann.2), it is explicit that petitioner never applied in the category of NFSA. In application form, NFSA category is mentioned at Serial No.12, which has been crossed by the petitioner.
4. Thus, on facts of case at hand, when petitioner did not apply under the NFSA category, her claim to award one mark is without substance. In that view, counsel for petitioner does not want to pursue the writ petition on merits and seeks permission to withdraw the same.
5. Permission is granted.
6. Accordingly, the writ petition is dismissed as withdrawn.
7. Stay application and other pending application(s), if any, stand disposed of.
