The captioned Writ Petition is filed seeking a Writ of Certiorari to quash the order dated 19.08.2019 passed by the third respondent in No.Food/Fair Price Depot/ CR/22/2019-20 vide Annexure-E. 3. Heard the arguments and perused the Writ papers with care. 4. The Suspension Order was passed by the Deputy Director, Food Civil Supplies and Consumer on 19.08.2019. The petitioner questioned the same before the Deputy Commissioner, Department of Food and Civil Supplies and - 3 - NC: 2025:KHC:2999 WP No. 51440 of 2019 Consumer Affairs, Mandya in Appeal No.01/2019-20. The petitioner also sought for stay of the Suspension Order. The Deputy Commissioner vide order dated 17.09.2019 granted interim order. However, on 22.11.2019 the interim order was not extended. Hence, the petitioner is before this Court. 5. The order sheet of the proceedings before the Deputy Commissioner is furnished along with the Writ Petition and the same is marked as Annexure-J. A careful perusal of the same reflects that the Deputy Commissioner has not extended the interim order. Suffice it to note that this Court vide order dated 29.11.2019 had stayed the suspension order. Since the appeal is pending before the Deputy Commissioner, this Court deems it proper to quash the order dated 22.11.2019. Accordingly, it is quashed. The interim order granted by this Court shall continue to operate till the disposal of the appeal by the Deputy Commissioner. 6. Resultantly, the Writ Petition is disposed of.
