The Court made the following ORDER:
1. This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue a Writ of Mandamus or any other appropriate writ or direction declaring the action of the respondents in trying to interfere and dispossess the petitioner from his subject land admeasuring an extent of Ac.0.52 cents situated in Sy.No.138-1 of Kongavanipalem village, Bhogapuram Mandal, Vizianagaram District as illegal, arbitrary, one without jurisdiction, contrary to the provisions of Andhra Pradesh Assigned lands (Prohibition of Transfers) Act 1977 and Rules, 2007 and in utter violation of Article 14, 21 and 300-A of the Constitution of India and consequently direct the respondents not to dispossess the petitioner from his subject land pending disposal of appeal case on the file of 3RD respondent and pass
2. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 3. The learned counsel for the petitioner submits that the petitioners preferred an appeal under section 4-A of Andhra Pradesh Assigned Lands (POT) Act, 1977 before the 3rd respondent, i.e., the Revenue Divisional Officer. Pending disposal of the said appeal, the respondent authorities are trying to interfere with the peaceful possession and enjoyment of the subject property of the petitioner and also threatening to dispossess the petitioner
without following due process of law as contemplated under law. Hence, the present Writ Petition. 4. The learned Assistant Government Pleader for Revenue appearing for the respondents submits that the respondents’ authorities will consider and dispose of the appeal preferred by the petitioner before the 3rd respondent/Revenue Divisional Officer and pass appropriate orders in accordance with law, within a reasonable time. 5.
Having regard to the submissions made by the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents and on perusal of the material available on record, this court is of the considered view that, the present writ petition can be disposed of by directing the 3rd respondent to consider and dispose of the appeal preferred by the petitioner and pass appropriate orders in accordance with law after providing an opportunity of hearing to the petitioner and other stake holders if any, within a period of three(03) months from the date of receipt of copy of this Order. In the meanwhile, status-quo obtaining as on today shall be maintained by the both parties in respect of the subject property. 6. With the above direction, the writ petition is disposed of. No costs.
