And 2 Others Counsel for Petitioner :- Bhagwan Dutt Pandey,Satyendra Kumar Singh Counsel for Respondent :- C.S.C.,Harshit Pandey Hon'ble Ajay Bhanot,J. Heard Shri Bhagwan Dutt Pandey, learned counsel for the petitioner, learned Standing Counsel for the State- respondents No. 1 and 2 and Shri Vibhu Rai, learned counsel for the respondent No. 3. The petitioner claims that he is entitled to ACP benefits. He has made a representation in this regard but to no avail. Shri Vibhu Rai, learned counsel for the respondent No. 3 submits that the matter requires determination of facts by the competent authority as per law in the first instance. However, he fairly contends that his claim for ACP benefit is liable to be decided by the competent authority in a reasonable time frame. In light of the aforesaid submissions and without going into the merits of the case, the respondent No.3-Nagar Ayukta, Nagar Nigam Gorakhpur is directed to decide the representation of the petitioner regarding ACP benefits as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. No good cause for failure of the petitioner to approach this Court on timely basis is disclosed. Hence the petitioner shall not be entitled to interest for the aforesaid period. However, in case there is delay in decision of the representation, the petitioner will become entitle to interest to such period of delay. With the aforesaid direction, the writ petition is finally disposed of. Order Date :- 22.4.2025 Jaswant Digitally signed by :- JASWANT KUMAR High Court of Judicature at Allahabad
