The petitioner has been made accused in connection with Bariyatu P.S. Case No. 71 of 2024, for the offences registered under Section 111(4) of the B.N.S. and Section 25(1-B) (A), 26/35 of the Arms Act, pending in the Court of Mrs. Swati Vijay Upadhyay, learned Judicial Magistrate, 1st Class, Latehar. 3. On 17.11.2024, at about 10:10 p.m., Bariyatu Police, on the basis of confidential information that unknown persons had assembled near a Mahua Tree in Golitand Jungle and were making preparation for committing dacoity, raided the place of occurrence and apprehended the accused persons. On search, arms and ammunition were recovered from the apprehended accused persons. 4. It was submitted that the petitioner was neither apprehended at the spot, nor anything was recovered from his possession. It was further submitted that co-accused Sanjay Ram who was apprehended at the spot, has been granted bail by this court. 5. Mr. Bishambhar Shastri, learned A.P.P. on specific query, whether the petitioner was apprehended at the spot, replied in negative. 6. In view of the aforesaid facts, I am inclined to release the petitioner on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Mrs. Swati Vijay Upadhyay, learned Judicial Magistrate, 1st Class, Latehar in connection with Bariyatu P.S.
