Heard Sri P.Narasimhulu, learned counsel for the petitioner and Sri A.S.C.Bose, learned Standing Counsel for respondent No.2 and learned Assistant Government Pleader for Municipal Administration and Urban Development. 3. Today, when the matter is taken up for admission, the learned Standing Counsel placed on record a copy of the written instructions received from the 2nd respondent-Municipal Corporation, stating that the Corporation had already issued a notice to the unofficial respondent on 04.01.2025, to stop the unauthorized construction, and a show-cause notice had also been issued to the unofficial respondents. It also reflects that the unofficial respondent had also submitted an explanation dated 06.01.2025, stating that the construction had been immediately stopped and that on northern side of his plot, a 30-feet road is existing, and he has not constructed any building on the road. It is further noted from the written instructions that the Corporation had already circulated the file to conduct a survey into the allegations of the petitioner. The said instructions further reveals that appropriate action would be taken after receiving of the survey report. 4. The written instructions of the respondent No.2 are placed on record. 5. The Writ Petition is disposed of, directing the respondents to take appropriate action in the matter as expeditiously as possible, after hearing 3 both the petitioner and the unofficial respondent, within two (2) months from the date of receipt of this order. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
