By way of instant application, prayer has been made on behalf of applicant/petitioner for revival of contempt proceedings for the reason that mandate contained in the judgment, alleged to have been violated, has not been complied with. Before reply, if any, from the respondents could be received in the instant application, Mr. Rajan Kahol, learned Additional Advocate General, has placed on record copy of office order dated 04.12.2025, issued under the signatures of Director of School Education, Himachal Pradesh, which is taken on record. Perusal of afore communication reveals that though respondents considered the case of the petitioner in light of Sunder Singh’s judgment, but same has been rejected on the ground that petitioner has already been granted been granted higher grade pay after two years of his regular service. In view of the above, nothing remains to be adjudicated in the instant application and accordingly, the same is disposed of reserving liberty to the applicant/petitioner to file appropriate proceedings in appropriate Court of law, laying therein challenge to order dated 04.12.2025 passed in purported compliance of the judgment, alleged to have been violated, if so advised.
