Apprehending his arrest in connection with FIR No. 296/2024 registered at Police Station Govindgarh, Alwar District Alwar for the offence(s) under Section 303(2) of BNS, the petitioner has preferred this anticipatory bail application under Section 482 of BNSS. 2. Learned counsel for the accused-petitioner submits that the petitioner has falsely been implicated in this case. Learned counsel further submits that petitioner has appeared before the concerned investigating officer in pursuant to the direction of this court vide order dated 12.12.2024. It is further contended that the petitioner is a bonafide purchaser of the buffalo and he purchased the buffalo from the other co-accused Isabdeen who has already been enlarged on bail. Custodial investigation of the petitioner is not required as the stolen buffalo has already been recovered. There are no criminal antecedents against the petitioner, therefore the anticipatory bail application of the accused-petitioner may be allowed. (2 of 2) [CRLMB-13775/2024] 3. Learned Public Prosecutor vehemently opposes the bail application and submitted the factual report. 4. I have considered the overall allegations levelled in the FIR and contentions made by the counsel for the parties. 5. As per the factual report the alleged stolen buffalo has already been recovered from the possession of other co-accused. Custodial investigation of the petitioner is not required and petitioner is ready and willing to cooperate with the investigation. Considering the above facts, without expressing anything on the merits of the case, I deem it just and proper to allow the anticipatory bail application of the accused-petitioner. 6.
