Take the facts narrated in this company application and receipt of part of decretal amount of Rs.1,40,00,000/- through mediation proceedings ordered by the Additional District Court, Hosur, in R.E.P.No.8 of 2021 as stated at para Nos.7 to 9 above on record; 2. Permit the official liquidator to file compliance report before this Hon’ble Court on receipt of the balance decretal amount along with interest as per order of Additional District Court, Hosur in R.E.P.No.8 of 2021, for further directions with regard to handing over the possession of subject property to judgment debtors; and 3. Pass such further or other order or orders as this Hon’ble High Court may deem fit and proper in the circumstances of the case. 2. Learned counsel for the official liquidator submits that in pursuant to order passed in O.S.A.No.36 of 2013 whereby the judgment debtor has admitted the liability of Principal amount, the Hon’ble Division Bench has revised the rate of interest from 18% p.a. to 6% p.a. and accordingly directed to clear off the principal amount along with interest within four months. In compliance of the same, after mediation proceedings an amount of Rs.1,40,00,000/- has been deposited on various dates. The details of such deposit have been mentioned in para 9 of the affidavit. Further out of the said amount, Rs.1,39,00,000/- has been deposited with 3 Punjab National Bank at Troop Bazar, Bank Street, Hyderabad for time being, after retaining an amount of Rs.1,00,000/- for meeting out the expenses. Since this Court, by order dated 20.08.2025, permitted the official liquidator to make fixed deposit of the amounts lying with him in State Bank of India, A.P.High Court Branch, necessary steps would be initiated in that direction soon. By placing aforesaid facts on record, by way of present application, compliance report has been placed on record indicating the factum of realization of Rs.1,40,00,000/- in the execution proceedings. Taking note of the same and also that the amount which has been now realized i.e., Rs.1,40,00,000/-, of which, Rs.1,39,00,000/- as now been deposited in bank account at Punjab National Bank which is likely to be moved to State Bank of India, A.P.High Court Branch, the application stands disposed of. There shall be no order as to costs.
