Neutral Citation No. - 2025:AHC:48404 Court No. - 5 Case :- WRIT - A No. - 3767 of 2025 Petitioner :- Yatish Singh Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Pradeep Kumar Keshri Counsel for Respondent :- C.S.C. Hon'ble Ajay Bhanot,J. Heard Shri Vyas Kumar Prasad, learned counsel holding brief of Shri Pradeep Kumar Keshari, learned counsel for the petitioner and learned Standing Counsel for the State. The petitioner is working on the Class IV post. He claims promotion to the post of Class III post. He has made a representation in this regard but to no avail. The only prayer made on behalf of the petitioner is that representation of the petitioner may be decided within a stipulated period of time. Learned Standing Counsel for the State submits that the matter requires determination of facts by the competent authority as per law in the first instance. However, he fairly contends that service benefit/claim is liable to be decided by the competent authority in a reasonable time frame. In light of the aforesaid submissions and without going into the merits of the case, the respondent no. 3 is directed to decide the representation of the petitioner regarding grant of promotion after considering all relevant facts including applicable provisions of law, seniority, service records and relevant service rules as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of. Order Date :- 5.4.2025 Dhananjai Digitally signed by :- DHANANJAI High Court of Judicature at Allahabad
