1. Since both the petitions arising out of same incident and the petitioners herein filed counter reports against each other therefore, they are considered and being decided by this common
order. 3
2. In Cr.M.P No. 3074/2024, the petitioner would pray for following relief:-
“It is therefore, prayed that the petition may kindly be allowed and Quash and set aside the First Information Report (FIR) bearing no 295/2023 registered in Purani Basti, Raipur (C.G) and quash and set aside the Impugned charge sheet arising there from against the petitioner, under Section 429 of the Indian Penal Code, as the allegations do not prima facie disclose any offence under this section, in the interest of justice.”
3. In Cr.M.P No. 2225/2024, the petitioner would pray for following relief:--- A. It is therefore prayed that this Hon’ble Court may kindly be pleased to allow this petition and pleased to quash the registration of F.I.R. No. 365/2023, filed against the present petitioners, in the interest of justice. B. Any other relief/order may also be granted that may be deemed fit and just in the facts and circumstances of the case. 4. The Case of the parties is that the stray dogs introduced by the complainant (petitioner in Cr.M.P. No. 2225/2024) in the locality attacked the son of the petitioner in Cr.M.P. No. 3074/2024 for which a dispute occurred between the parties and they lodged the reports against each other. In Cr.MP No. 2225/2024 the complainant/petitioner alleging that the petitioner in Cr.M.P. No. 3074/2024 and his family members threatened her with dire consequences. 4

From bare perusal of the pleadings and the documents appended in both the petitions it is manifest that the parties have lodged the reports against the each other regarding the attack of the stray dogs. 6. Learned counsel for the State would submit that after due investigation the charge sheet was filed before the competent court. He would submit that the proceedings initiated by the police authorities is just and proper and there is no illegalilty at all. 7. Having considered the entire facts and circumstances of the case and particularly considering the fact that there are counter reports against each other in respect of attack of stray dogs, without expressing any opinion on the merits of the matter, both the petitions are allowed and the FIR No. 295/2023 in (Cr.M.P. No. 3074/2024) registered in Purani Basti, Raipur (C.G.) as well as the FIR No. 365/2023 in (Cr.M.P. No. 2225/2024) and all consequential proceedings arising out of above-mentioned FIRs in both the petitions are hereby quashed.
