2025:JHHC:36440 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.5802 of 2025 ------ Arvind Kumar Kashyap, aged about 41 years, Son of Jag Prasad Kashyap, R/o Rani Bagicha Kathitand, PO-Ratu, PS-Ratu, District- Ranchi, Jharkhand … … Petitioner Versus The State of Jharkhand. … … Opposite Party ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Indrajit Sinha, Advocate Ms. Ashwini Priya, Advocate. For the State : Ms. Nehal Sharmin, Spl. P.P. (through VC) ----- 05/ 05th December, 2025 1. Heard the parties. 2. This is a second and successive Anticipatory Bail Application. 3. The Petitioner apprehends his arrest in connection with Ratu Police Station Case No.384 of 2023 for allegedly committing offence under Sections 414, 34 of the Indian Penal Code, Section 4/21 of the Mines and Minerals (Development & Regulation) Act, 1957, Rules 9/13 of the Jharkhand Minerals (Prevention of Illegal Mining, Transportation & Storage) Rule and Rules 4/54 of the Jharkhand Minor Mineral Concession Rule, 2004, pending in the Court of learned Judicial Magistrate, Ranchi. 4. Though a Second Anticipatory Bail Application on same cause is not maintainable, but from the facts narrated by the parties and admitted by the State, it is quite clear that Notice under Section 41A of the Code of Criminal Procedure was issued to the petitioner and the petitioner has complied the same by appearing before the I.O. It is also admitted that the I.O. has not arrested him and he is cooperating. That being so, there is no ground made out to take the petitioner in custody. 5. With the aforesaid observation, this Anticipatory Bail Application stands disposed of. (ANANDA SEN, J.) 05th December, 2025 S.K.D.-cp-3 Uploaded on 06/12/2025
