Hon'ble Avnish Saxena,J. 1.Sri Meva Lal Yadav, Advocate appears and submits that the accused/applicant has been falsely implicated in Case Crime No. 85 of 2023, under Section 3(1) U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police Station Bardah, District Azamgarh. 2. Learned counsel for the accused-applicant, contends that in gang-chart only one case has been shown against the accused-applicant in which he is on bail. The other 35 cases are shown in criminal history. It is submitted that in all the cases shown in the gang-chart the accused is on bail and has not been convicted in any of those cases. As such, he prays that the accused/applicant be enlarged on bail. 3. Learned A.G.A. has opposed the prayer for bail and submitted that there is no record to show that accused is on bail in all the cases shown against him. 4. This Court has taken into consideration the rival submissions made by learned counsel for the parties and perused the records which prima facie reveals that there is only one case shown in the gang-chart and in all the cases there is no conviction as per the record which is conceded by learned A.G.A. The applicant is in jail since 18.09.2023. 5. As such the bail application is allowed. 6. The accused/applicant-Sunil Kumar be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of court concerned.
